1. Agreement to Terms

By accessing or using CryptoCaptains.com ("the Site") or the Crypto Captains Discord community ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. The Service is operated by Torin Hofmann ("Tor", "we", "us").

2. Not Financial Advice

The content provided through the Service - including but not limited to TorOS reports, watchlists, market research, community discussions, live AMAs, and any other materials - is for educational and informational purposes only.

Nothing on this Site or within the Service constitutes financial advice, investment advice, trading advice, or any other kind of professional advice. You should not treat any of the content as such. We do not recommend that any cryptocurrency should be bought, sold, or held by you. We are not licensed financial advisors, brokers, or dealers.

Any decisions you make based on information found through the Service are made at your own risk. You are solely responsible for your own investment decisions, financial choices, and trading activity.

3. No Guarantees

We make no representations, warranties, or guarantees regarding the accuracy, completeness, timeliness, or reliability of any information provided through the Service. Past performance of any trading system, methodology, or individual trader is not indicative of future results.

TorOS is an automated research tool. Its outputs - including market data, watchlists, momentum scores, and research insights - are generated algorithmically and may contain errors, inaccuracies, or outdated information. You should independently verify any information before making decisions.

Cryptocurrency markets are highly volatile. You can lose some or all of your invested capital. Never invest more than you can afford to lose.

4. Limitation of Liability

To the maximum extent permitted by applicable law, Torin Hofmann, Crypto Captains, and any affiliated parties shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages - including but not limited to loss of profits, data, income, or investment capital - arising out of or in connection with your use of the Service, whether based on warranty, contract, tort, or any other legal theory, and whether or not we have been advised of the possibility of such damages.

You expressly agree that your use of the Service is at your sole risk. The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied.

5. Indemnification

You agree to indemnify, defend, and hold harmless Torin Hofmann, Crypto Captains, and any affiliated parties from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with your use of the Service, your violation of these Terms, or your violation of any rights of another party.

6. Membership and Payments

Membership fees are processed through LaunchPass. By subscribing, you agree to pay the applicable membership fee on a recurring monthly basis. You may cancel your membership at any time through the LaunchPass dashboard.

Upon cancellation, your access to the Service continues until the end of your current billing period. No refunds are provided for partial billing periods. We reserve the right to change membership pricing at any time. Existing members at founder rates will retain their locked pricing.

7. Acceptable Use

You agree not to:

• Redistribute, resell, or share paid content outside the community
• Use the Service for any unlawful purpose
• Impersonate Torin Hofmann or Crypto Captains staff
• Harass, abuse, or harm other community members
• Post spam, scam links, or promotional content without permission
• Attempt to scrape, copy, or reverse-engineer TorOS or its outputs

Violation of these rules may result in immediate termination of your membership without refund.

8. Intellectual Property

All content, materials, and technology provided through the Service - including TorOS, market reports, watchlists, and educational materials - are the intellectual property of Torin Hofmann. You are granted a limited, non-exclusive, non-transferable license to access and use the Service for your personal, non-commercial use only.

9. Risk Disclosure

Cryptocurrency trading involves substantial risk of loss. The value of cryptocurrencies can fluctuate significantly, and you may lose more than your initial investment. You should carefully consider whether trading or holding cryptocurrencies is suitable for you in light of your financial condition and risk tolerance.

The information provided through the Service should not be relied upon as a substitute for your own independent research, judgment, and due diligence. Always do your own research before making any investment decisions.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Alberta, Canada, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Alberta, Canada.

11. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated revision date. Your continued use of the Service after any changes constitutes acceptance of the updated Terms.
